Kejriwal Jail Act raises question on role of Indian Judiciary & Corrupt media

The way Indian media is promoting their news and shows naming as Drama or Nautanki is not only unethical, but it proves the notorious role of Indian media too. The reason is clear – Arvind Kejriwal told before election – “If we come to power, all paid media must have to go to jail.”  After that, corporate driven Indian media jumped to defame Kejriwal and continued their notoriety hiding all the facts.

Yes, we can accept that the acts of Arvind Kejriwal are first definitely questionable whether he is genuine or not. But the way he has been put behind bars indeed puts a question mark on Indian Judicial system in broader context.

Arvind Kejriwal is put behind the bars because Nitin Gadkari filed a defamation charge against him – Kejriwal had accused Gadkari of corruption several months ago. The Timing of the Arrest itself is questionable as this happened as soon as the National Polls results declared BJP as the new power horse of Delhi. The defamation filed was several months ago, but till the time Kejriwal was the CM of Delhi or he was contesting Modi in Varanasi, there was no much movement of the case. But as soon as Gadkari and BJP comes to power, Kejriwal is put behind bars. But Gadkari was exempted to appear in court. In trial of a defamation case – is it mandatory for accused and plaintiff to appear in court in every hearing! If not for the plaintiff, then why? It should be a debate. Moreover, in defamation case, the plaintiff needs to prove what is his fame and how he is defamed. So, what is Gadkari’s fame? This also leads towards another controversy and debate. The Gadkari defamation case  raises the question on whether the Judiciary acts only as per the directions of the power honker.

It is really questionable that why a bail bond should be mandatory in a defamation case! Earlier too such happened to Arvind Kejriwal where Kejriwal was released on his personal assurance of appearing in court. But this time judge’s role raised questions.

Most importantly, today Kejriwal is jailed and all national media playing their notorious game by naming Arvind Kejriwal’s act as Drama or Nautanki. No one should forget what other political leaders said defamatory about Arvind Kejriwal. Lets have a look:

“Arvind Kejriwal is a Pakistani Agent”- said Narendra Modi before Lok Sabha Election 2014.
“Arvind Kejriwal is an item girl'” – Uddhab Thakre said before Lok Sabha Election 2014.

Who is defamed?

Arvind Kejriwal did try to do a Gandhi by refusing to pay a meagre of amount of Rs 10,000 as he claimed to stand up to his principles. While we can mock him for avoiding the easy route of escape, it is also true that the law itself (in this case) seems to be a bit odd. In such defamation case, the complainant can just file a charge and sit and relax at home because the accused has to bear all the trouble even before there is justice delivered. There is no reason why a bail security has to be paid if someone is not yet guilty.

The law of the Land, most of it introduced by the British even before the birth of Arvind Kejriwal, most of you and I were born is getting torn and weary. Just because change management in a difficult job, all the laws still remain. It is time we indeed demanded true and developed Swaraj.

But only time will tell if it would be Kejriwal’s unfathomable antics or Modi’s iron speeches that will bring any change and modernization. We can only hope.

    A very beautifully brought out article, and really thought provoking. It sets our mind thinking and we must have a national debate and start the judicial reforms and something to do with the accountability of the media too.
    We have nothing against the media per sey. while reporting some news may turn out to be incorrect etc, that is ok, and fair enough, but blatantly distort the news and project it to harm some one is not the purpose of news channels.

    judicial reforms are a must here — there are many instances , where if a petty thief is not able to furnish a bail bond he has been kept in jail for several years , whereas his punishment may have been just a few months for that crime if convicted

    In case anyone was interested in understanding why the private agenda setting elite media acts the way it has in the coverage of Mr Kejriwal’s imprisonment, and the assisted derision of the AAP and Mr Kejriwal, they should read about “the Propaganda Model”, which is an institutional analysis of the media in a modern democratic society, done my Noam Chomsky and Edward S. Herman in their book “Manufacturing Consent: The Political Economy of the Mass Media” (1988). India may still largely be feudal, yet the pockets that are influenced by the AAP are mostly democratic.

    I just want to add that the ‘meagre’ amount of 10,000 is actually half the annual income of about 22.3 percent of the people. Most people fail to get bail because they can’t get that kind of money.

    Been a long time since I read an honest article on this ongoing episode like this one. Media is general is owned by Corporates. And then there are sold lots who post the messages against those articles. Even plain simple logically straight forward conclusions are presented as completely opposite. Due to this, common people are hugely manipulated now. The general elections are now a history !

    Although I don’t subscribe to actions taken by Kejriwal and his party which look amateur because of lack of political experience.However, It was totally unfair of the media to call Kejriwal’s not submitting the Bond as drama and him as dramabaaj.It showed the prejudice against him.First there is little logic why in such cases there is a need to give a personal bond or surety even if such procedure exists( I believe it’s discretionary and not mandatory) as the inheritance of colonial mindset still prevalent in the country’s legal procedures even 66 years after British left India. Kejriwal was rightly protesting against this practice but he was mocked at,jeered at by every Tom .Dickens and Harry who were guided more on the perception created by the media than analysing the situation more prudently and logically as the writer of this article has very ably done. It appears that Off late Media appears to be hankering after the blood of Kejriwal for he dared to speak against them.

    A man leaves his cushy job, lives simple, thinks & acts for public good, associates himself strongly with RTI and Jan lok pal movement, joins politics with an intent only to cleanse it from within & tries to make an effort. Many of us may hold a view that AK made mistakes but then it is a matter of perception. I do remember all AAP ministers were so seriously & dedicated engrossed in pursuing welfare of Delhites in whatever small time they got to govern. How can we forget Manish Sisodia visiting night shelters till late hours every night when it was so unbearable cold outside. Similarly, for the health minister of the time, I had not seen such commitment & feeling for the poor from the politicians earlier. If you take it positively, tell me as to what wrong Som Nath Bharti did ! He fought against the nuisance that people of his constituency faced everyday for years. In the face of the fact that police wouldn’t & didn’t act, Bharti went a little overboard and got carried away. But all along he had public good at heart. AK had to come out on streets for police inaction. He spent a night in extremely cold weather and to make a show of it. Can any one of us do it ! I do not know as to why we all and in particular our (so called paid) media is busy only finding faults in whatever AK and AAP members do. Overall, one feels sad when media consciously sides with the evil.

Carry on such more fearless thoughts..I believe what has been done-cannot be undone (elections 2014)-what remains is that we reflect what went wrong, how the Nation was duped, and what should have been done,but wasnt done.Kejriwal may be nice and honest-but he must be eloquent.He must learn to express his opinions before his actions, not like a lightning and then thunder.(well thats how Indian democracy works!!)
    Rhetorics of politics are similar to the ubiquitous stage acts of Sita Haran and likes-more drama & less action. Aam Aadmi is like that only.
    BJP repotedly spent over 4500cr this time,naturally PAID NEWS is a reality,we cannot wish away.

See you said something against the system/ power party then you had to define on paid media, etc. But other newspaper when were publishing modi modi, noone said so since we all know that was paid media 101%.     All this that you have written is fine. It maybe your opinion on the issue. But you must understand that firstly there is a procedure to be followed in law which has been prescribed by it. Furnishing a bail bond isn’t a big deal but making a big deal out of it is what is appalling. Arvind Kejriwal has lost all credibility, it is clear from what has happened in the Lok Sabha polls and recently the AAP party members resigning stating reasons like the party needs to reinvent itself.

    There are no heroics in writing articles like these. I voted for AAP in the Delhi Assembly elections hoping that this man would turn out true to his word. He did not. HE FAILED AN ENTIRE CITY of hopefuls. HE went for greed. the Lok Sabha elections, without proving that he and his party had it in them to run a city. Everything that they did in the 49 days is now null and void. There were many other reasons he should have held on for but he chose not to. Played with emotions and sentiments of the many who voted for him. He now apologizes for it.

    As far as comments against Kejriwal are concerned he can file a defamation suit against all those who have passed such comments.

    He has completely let down the people of this city and they are disgruntled and all those people who voted for him. That is all that there is to this. The rest is not important.

    If some body saying that your’s is paid news/report. Then why are you asking them to come with proof. Instead, why don’t you file defamation case against those people. As you are referring to this Nitin Gatkari / Kejriwal case, you can file defamation case and sit and relax.

    I definitely agree with TOA. In fact, I would also like to draw your attention to the so called “inflation” of which BJP took advantage during Delhi Assembly polls. The day results were declared, prices of all the vegetables were brought to half. Was this a miracle by the BJP gurus or mere hoarding till the declaration of results! Well what so ever.. I’m pretty sure this government won’t be able to complete is term even!
    Modi is just a reader of pre-written speeches who can’t even give replies to the countrymen if asked spontaneously..
    Moreover 500 crores that BJP spent for its publicity will be needed to recovered. I’m just getting ready to bear that hole in my pocket..so should my country fellows.
    Even now after elections BJP is so much afraid of AAP that they would do anything to harm him.
    The truth is nation building can’t be the task of just one person which kejri understands very well whereas modi is still trying to keep his blind followers in dark that he will do all the task himself and they just need to go and sit.

    Good and right clarification by TOA. We should not expect any change of British Raj Laws. These were made for people in ‘Power ‘. Why should we think that the people in ‘Power’ now will commit a blunder to change .

    Unbiased article. I am in chennai and also the supporter of AK’s principle. Modestly I really like the way you approve the coments. When AK/s daugher was appearing for IIT jee exam, AK was in jail. This also other termed it as drama and AK wantedly doing it for his publicity. Which father would prefer to be in jail.
    See now, you are a media and you are publishing how media is behaving. How can it be a drama and when some people say it is drama, they lack sense and i really pity their ignorance. Here I want to emphasis that every comment which comes from public has a process like how you approve, I think that most of us would come in favour of honest politician. I wish your media a great future with values what you preserve. If wish other social medias follows your principles for posting comments and expressing their views.
